Guest degsey69 Posted February 25, 2006 Share Posted February 25, 2006 I looked at the Turbo Cash programe issue again and in my post there was a thread that pointed to this post, is there any relavence to CubeCart in this. "I've looked at the specific GPL license they used (which happens to be a completely unmodified version) and the source for TurboCASH as it's currently available for download. As it currently stands TurboCASH is in clear violation of the GPL. Now, the GPL at it's heart is a Copyright license. As such it enables the holder of that copyright to legally enforce the terms of the licenses. As the © holder they are safe from being sued for violation of the license because the only one who could do that is the © holder. But anyone else who re publishes TurboCASH or any work based in at least some part on TurboCASH is also in violation of the GPL as long as not all references to non-GPLed code are removed. It doesn't matter in that case that the code as published by the © holder is already in violation of the GPL. This potentially opens anyone except the original copyright holder who publishes TurboCASH in modified or unmodified form as long as these modifications do not completely and entirely remove any reference to code that is not under the GPL. The people responsible for putting TurboCASH under the GPL don't seem to have put sufficient effort into exploring what the consequences of that action are. Anyone who uses or publishes TurboCASH without removing these license violations (with the exception of the copyright holders) is on shaky legal ground. I would very strongly suggest anyone who considers to use TurboCASH or modify TurboCASH or publish a modified or unmodified version of TurboCASH to take into account the potential consequences.
